Represented former International President of United Transportation Union ("UTU") in an ERISA claim against the UTU and Pension Administrative Committee members. Bench trial resulted in plaintiff's verdict of $287,007 and attorney's fees and costs.
Buyers v. Seller
Arbitration Service of Portland, Multnomah County (Oregon)
Represented homeowners in claims for fraud, breach of contract, and breach of the implied duty of good faith and fair dealing against seller. Arbitration resulted in verdict for homeowner's and attorney's fees and costs.
First Pacific Mortgage, Inc. v. Mason, et al
Clark County Circuit Court (Washington)
Represented mortgage broker against mortgage company's claims for breach of contract, breach of fiduciary duty, and misappropriation of trade secrets, and for injunctive relief. Court denied mortgage company's motion for preliminary injunction and then mortgage company dismissed the case.
Mariner Systems, Inc. v. Triad Systems, Inc. et al
U.S. District Court for the District of Oregon
Represented a medical software company in claims for injunctive relief, breach of contract, breach of fiduciary duty, misappropriation of trade secrets and other business torts against multiple defendants. Damages sought were over $1 million. Settled.
Eagle Point Golf Club, LLC v. Barkin
Jackson County Circuit Court (Oregon)
Represented golf club in declaratory relief action to determine defendant's status as either an independent contractor or employee and against counterclaims for breach of contract, quantum meruit, and intentional and negligent infliction of emotional distress among others. Settled.
West Star Construction, Inc. v. BRE Builders, Inc. and BRE Properties, Inc.
King County Circuit Court (Washington)
Represented framing subcontractor in breach of contract, breach of the implied duty of good faith and fair dealing, and fraud claims for over $500,000 in damages against general contractor and Fortune 500 real estate investment trust. Settled.
Pollock v. D.R. Horton, Inc.
Multnomah County Circuit Court (Oregon)
Represented publicly traded home builder against an executive's claims for breach of contract and breach of the covenant of good faith and fair dealing. Plaintiff claimed $10 million in damages. Brought counterclaims for breach of fiduciary duty and restitution. Settled during jury trial.
Pacific Financial Funding, Inc. v. West Star Construction, Inc. et al
Multnomah County Circuit Court (Oregon)
Represented construction subcontractor and individual guarantors sued for breach of contract and action on a guaranty. Defendants were sued for more than $1 million. Bench trial resulted in defense verdict and attorney's fees and costs. Affirmed without opinion on appeal.
